You can take him back to court, but beware that most divorce attorneys do not fully understand that banks and mortgage companies do not have to recognize divorce degrees. So, if your X husband has sold the house and was supposed to pay off debt or a payout to you, it is very unlikely that he will face any legal consequences for not doing so. At this point, you can take your X husband to small claims court with a copy off your divorce degree to show evidence that he failed to pay of 9 grand. The court will allow your X husband to show evidence as well. If the court decides that he has not furfilled his legal obligation, they may allow a forced payroll deduction. Check with your local court because they may consider 9k to be outside of the small claims court. In this case, you will need to get an attorney or go directly to the court and file the papers for yourself.
