Petraeus, Men And Women In Uniform By Kit Lange WASHINGTON -- House Republican Whip Roy Blunt (Mo.) issued the following statement this afternoon after the House overwhelmingly approved a resolution condemning "in the strongest possible terms" MoveOn.org's personal attacks on General David Petraeus, as well as honoring "all members of the Armed Forces," and their families, for "serving in harm's way." Seventy-nine Democrats voted against it. "It's been more than two weeks since the Republican Leader introduced a resolution condemning MoveOn's personal smear campaign against Gen. Petraeus, and nearly a week since the Senate passed its own version and the House majority leader told me he had no intention of allowing a similar vote in our chamber. "Today, we took matters into our own hands, forcing the House to take up a resolution repudiating these personal attacks, and reaffirming our support for and gratefulness to the men and women serving our country in harm's way. "Given the chance, more than three-quarters of the House went on record today in support of our Armed Forces, and in recognition of the extreme sacrifices they and their families make for our country on daily basis. My only disappointment is that a message as important and clear-cut as this couldn't attract the support of every member of this chamber." NOTE: The House Committee on Foreign Affairs took up a similar resolution earlier in the day, returning a vote of 23-13 in favor of quashing the Petraeus resolution and preventing it from even being considered in committee. Many of those members voting in the affirmative came down differently on the issue when presented with the matter on the House floor. Commentary on the motion by Chris Hill, Gathering of Eagles National Director for Operations: The motion recognized the service of General Petraeus, as well as all other members of the Armed Forces and civilian personnel serving in harm's way, as well as their families. It also condemned in the strongest possible terms the personal attacks made by the advocacy group MoveOn.org impugning the integrity and professionalism of General Petraeus. 79 Democrats opposed the resolution. Their names are below. If your member of Congress is listed below, call and ask them why they refuse to support our men and women in uniform. Ask them if this is what they mean when they say "I support the troops." These 79 members of Congress had the chance to publicly support the troops, or support their cash cow MoveOn.org. They chose the latter. This is why we have to turn out in the streets. This is why we have to stalk the halls of Congress. This is why our mission to support our men and women in uniform hinges on each and every one of us. When elected officials will not even disavow a repugnant ad put out by an anti-American organization it is time for us, the Gathering of Eagles and our fellow patriots in other organizations, to remind them that they work for us. The 79 members of Congress listed below sided with those who call our brave warriors war criminals. They sided with those who call the commanding general in Iraq a traitor. In short, they decided that it was better to have funds from an organization that believes in destroying our American way of life, than it was to stand up for those who have so bravely stood up for all of us. How? The Veterans Disarmament Act -- which has already passed the House -- would place any veteran who has ever been diagnosed with Post Traumatic Stress Disorder (PTSD) on the federal gun ban list. This is exactly what President Bill Clinton did over seven years ago when his administration illegitimately added some 83,000 veterans into the National Criminal Information System (NICS system) -- prohibiting them from purchasing firearms, simply because of afflictions like PTSD. The proposed ban is actually broader. Anyone who is diagnosed as being a tiny danger to himself or others would have his gun rights taken away ... forever. It is section 102(b)(1)(C)(iv) in HR 2640 that provides for dumping raw medical records into the system. Those names -- like the 83,000 records mentioned above -- will then, by law, serve as the basis for gun banning. No wonder the Military Order of the Purple Heart is opposed to this legislation. The House bill, HR 2640, is being sponsored by one of the most flaming anti-Second Amendment Representatives in Congress: Carolyn McCarthy (D-NY). Another liberal anti-gunner, Sen. Patrick Leahy (D-VT), is sponsoring the bill in the Senate. Proponents of the bill say that helpful amendments have been made so that any veteran who gets his name on the NICS list can seek an expungement. But whenever you talk about expunging names from the Brady NICS system, you’re talking about a procedure that has always been a long shot. Right now, there are NO EXPUNGEMENTS of law-abiding Americans’ names that are taking place under federal level. Why? Because the expungement process which already exists has been blocked for over a decade by a "funds cut-off" engineered by another anti-gunner, Sen. Charles Schumer (D-NY). So how will this bill make things even worse? Well, two legal terms are radically redefined in the Veterans Disarmament Act to carry out this vicious attack on veterans’ gun rights. One term relates to who is classified a "mental defective." Forty years ago that term meant one was adjudicated "not guilty" in a court of law by reason of insanity. But under the Veterans Disarmament Act, "mental defective" has been stretched to include anyone whom a psychiatrist determines might be a tiny danger to self or others. The second term is "adjudicate." In the past, one could only lose one's gun rights through an adjudication by a judge, magistrate or court -- meaning conviction after a trial. Adjudication could only occur in a court with all the protections of due process, including the right to face one's accuser. Now, adjudication in HR 2640 would include a finding by "a court, commission, committee or other authorized person" (namely, a psychiatrist). Forget the fact that people with PTSD have the same violent crime rate as the rest of us. Vietnam vets with PTSD have had careers and obtained permits to carry firearms concealed. It will now be enough for a psychiatric diagnosis (a "determination" in the language of the bill) to get a veteran barred for life from owning guns. Think of what this bill would do to veterans. If a robber grabs your wallet and takes everything in it, but gives you back $5 to take the bus home, would you call that a financial enhancement? If not, then we should not let HR 2640 supporters call the permission to seek an expungement an enhancement, when prior to this bill, veterans could not legitimately be denied their gun rights after being diagnosed with PTSD. Veterans with PTSD should not be put in a position to seek an expungement. They have not been convicted (after a trial with due process) of doing anything wrong. If a veteran is thought to be a threat to self or others, there should be a real trial, not an opinion (called a diagnosis) by a psychiatrist. If members of Congress do not hear from soldiers (active duty and retired) in large numbers, along with the rest of the public, the Veterans Disarmament Act -- misleadingly titled by Rep. The gun PTSD scare does not seem to hold water! As a life long gun owner and long term member of the NRA I am obviously opposed to any gun control that would infringe on my rights or others like me. By the same token I am opposed to letting just ANYONE buy a gun. For just two examples, most especially anyone who has been adjudicated by a court to be mentally incompetent or any illegal alien! Semper Fidelis Bob Rohrer www.BobRohrer.com H.R. 2640, The "NICS Improvement Act," Passes House By Voice Vote Friday, June 15, 2007 On June 13, the U.S. House of Representatives overwhelmingly passed H.R. 2640, the "NICS Improvement Act," by a voice vote. H.R. 2640 is consistent with NRA's decades-long support for measures to prohibit firearm purchases by those who have been adjudicated by a court as mentally defective or as a danger to themselves or others. Additionally, H.R. 2640 makes needed, and long overdue, improvements to the National Instant Criminal Background Check System (NICS). While the media continues to characterize this bill as a "gun-control" measure, nothing could be further from the truth. The national media either have not bothered to read and accurately assess the text of the bill, or are deliberately manipulating and "spinning" the facts in order to stir up controversy and forward their agendas. Here are the facts: H.R. 2640 would provide financial incentives to states to make records of prohibited individuals available for use in the NICS, and would also require federal agencies to provide such records. Those blocked from buying a gun due to these newly provided and updated records in the NICS are already prohibited under current law from owning firearms. The basic goal of the bill is to make NICS as instant, fair, and accurate as possible. While no piece of legislation will stop a madman bent on committing horrific crimes, those who have been found mentally incompetent by a court should be included in the NICS as they are already prohibited under federal law from owning firearms. H.R. 2640 is sound legislation that makes numerous improvements over existing federal law, including: Certain types of mental health orders will no longer prohibit a person from possessing or receiving firearms. Adjudications that have expired or been removed, or commitments from which a person has been completely released with no further supervision required, will no longer prohibit the legal purchase of a firearm. Excluding federal decisions about a person's mental health that consist only of a medical diagnosis, without a specific finding that the person is dangerous or mentally incompetent. This provision addresses concerns about disability decisions by the Veterans Administration concerning our brave men and women in uniform. (In 2000, as a parting shot at our service members, the Clinton Administration forced the names of almost 90,000 veterans and veterans' family members to be added to a "prohibited" list; H.R. 2640 would help many of these people get their rights restored.) Requiring all participating federal or state agencies to establish "relief from disability" programs that would allow a person to get the mental health prohibition removed, either administratively or in court. This type of relief has not been available at the federal level for the past 15 years. Ensuring--as a permanent part of federal law--that no fee or tax is associated with a NICS check, an NRA priority for nearly a decade. While NRA has supported annual appropriations amendments with the same effect, those amendments must be renewed every year. This provision would not expire. Requiring an audit of past spending on NICS projects to find out if funds appropriated for NICS were misused for unrelated purposes. Neither current federal law, nor H.R. 2640, would prohibit gun possession by people who have voluntarily sought psychological counseling or checked themselves into a hospital: Current law only prohibits gun possession by people who have been "adjudicated as a mental defective" or "committed to any mental institution." Current BATFE regulations specifically exclude commitments for observation and voluntary commitments. Records of voluntary treatment also would not be available under federal and state health privacy laws. Similarly, voluntary drug or alcohol treatment would not be reported to NICS. First, voluntary treatment is not a "commitment." Second, current federal law on gun possession by drug users, as applied in BATFE regulations, only prohibits gun ownership by those whose "unlawful [drug] use has occurred recently enough to indicate that the individual is actively engaged in such conduct." In short, neither current law nor this legislation would affect those who voluntarily get psychological help. No person who needs help for a mental health or substance abuse problem should be deterred from seeking that help due to fear of losing Second Amendment rights. This bill now moves to the Senate for consideration. NRA will continue to work throughout this Congressional process and vigilantly monitor this legislation to ensure that any changes to the NICS benefit lawful gun purchasers, while ensuring that those presently adjudicated by the courts as mentally defective are included in the system. If anti-gun Members of Congress succeed in attaching any anti-gun amendments to this bill, we will withdraw support and strongly oppose it! Questions arise about medals on vet leader By Linda Reilly Times Correspondent PHILADELPHIA -- A prominent leader among Delaware County veterans wore military medals he never earned -- including the Silver Star, Bronze Star and Purple Heart, according to federal prosecutors. James Anthony Alleva, 54, of the 200 block of South Lynn Boulevard, Upper Darby, commandant of the Marine Corps League General Smedley D. Butler Detachment 741 of Newtown Square, was formally charged, ordered to surrender his passport and released on $10,000 bail pending disposition of the case filed by U.S. Attorney Patrick L. Meehan and FBI Special Agent-in-Charge J.P. Weis. Alleva allegedly altered his military discharge certificate, wore unauthorized military medals or decorations and falsely represented himself as an award recipient of commendations achieved in action governed under federal laws. According to the Assistant U.S. Attorney Jose R. Arteaga, Alleva was cited Aug. 7 for allegedly altering his military discharge certificate and Feb. 5 and Aug. 7 for illegally wearing the Silver Star medal, the Bronze Star medal, two Purple Heart medals, awards only authorized by Congress, and Parachute Jump Wings and a SCUBA Badge for completing diver school. If convicted of all charges, Alleva faces a maximum sentence of two years imprisonment, one year supervised release and an $110,000 fine. "I plan to vigorously defend these charges," Alleva, a member of 741 since 2002, said, claiming disgruntled members of the detachment have it out for him. "They are envious of the way things are going and they are trying to discredit me and the detachment. It's a vicious, immature, cowardly attack against me and the detachment," Alleva said. Alleva announced plans to turn over leadership of the detachment to the senior vice commandant for the month of October. Reaction among local veterans was mixed. Several said they were not surprised by the accusation. Paymaster and 741 Past Commandant Bob Spano, 58, of Drexel Hill, recalled Alleva "talking to us about the Upper Darby (884 Detachment) people doubting his medals. "People in the military are very sensitive to others wearing medals they don't deserve," Spano said. "It is nothing we would approve of and something we would be embarrassed about. Unfortunately it happens in all branches of the military. I don't accuse anybody. That is up to the law. It's being handled by the proper channels. It's their jurisdiction." According to Spano, a 1969 Vietnam veteran and recipient of the Combat Action Ribbon and member of 741 since 2000, new members to any detachment have to provide a record of honorable discharge to qualify for membership. Since Alleva transferred from 884 in good standing to 741 that wasn't required, Spano says. Former Commander Bob Stanton of Ridley Park, now sergeant-at-arms and commander of the Young Marines at 741, wondered why anyone would lie about their service record. "I questioned him a couple of times after I saw the Silver Star and Bronze Star," Stanton said. "I thought there was no way anybody could have done all this" during the time Alleva served in the Marines. "He says he has everything he says he has." USMC Capt. J. David Fleming of Lansdowne, stationed in Quantico, Va., after three tours to Iraq, called the allegations of wearing undeserved medals "infuriating" and cited the enactment of the 2005 Stolen Valor Act. "We have our own value system in the Marines -- selflessness, honor, courage," Fleming said. "We give those things value. When a man or woman is selfless we recognize them by giving them a medal. To have an imposter lie that he demonstrated a heroic act detracts from the medal. "The real guys who received medals don't go around promoting themselves. The real heroes prefer to be unrecognized. It's important for us to keep the value system intact. Danny Santos, who had shrapnel in his gut, there's a Silver Star recipient. Jason Dunham, who smothered a grenade with his body and lived seven days, there's a Medal of Honor recipient. These are the heroes," Fleming said. The Crawfords, a Drexel Hill family of Marines and members of MCL Upper Darby Detachment 884, said they were saddened and angered by the charges. Ed Crawford, 79, served in World War II, Korea and Vietnam and has five Purple Hearts and a Bronze Star. His son, David Crawford, 49, is a retired recruiter. His grandson, Matt Crawford, 27, toured Iraq twice and is a Purple Heart recipient. "It made me feel bad," the elder Crawford said. "I knew guys who were wounded or killed and should have gotten all those medals and never got them, and he's wearing them. He dishonored people that really deserved the medals." "He dishonored himself and anybody else who ever received a medal," Dave Crawford said. "A lot of people went through a lot of pain for the Purple Heart," said Matt Crawford, who lost sight in his right eye from an improvised explosive device in Iraq. "It's not right for someone to pretend they have it. To earn the Bronze or Silver Star you pretty much have to put your life on the line. If he did wear it and didn't rate it, he's a scumbag." Harsh but true. Prosecutors: Faked military records cost VA, tarnished medals By GENE JOHNSON AP LEGAL AFFAIRS WRITER SEATTLE -- Eight people who faked their military service in conflicts dating to World War II have been charged in the Northwest this year, and another four cases are under investigation, federal officials said Friday. The fraudulent claims not only dishonored those who actually served, but also cost the Veterans Administration and other agencies more than $1.4 million in benefits, said Doug Carver, with the VA's Office of the Inspector General. There are dozens more cases pending across the country, he said. "The 'phony war hero' phenomenon ... tarnishes the service of thousands of veterans who have served honorably," Carver said. "It strangles VA resources from providing critical care and benefits from deserving veterans." Carver spoke at a news conference at U.S. District Court following the sentencing of Jesse Macbeth, a 23-year-old Tacoma resident who tried to position himself as a leader of the antiwar movement by claiming to have participated in war crimes in Iraq. In reality, Macbeth, who also sought medical benefits for post-traumatic stress disorder, was kicked out of the Army after six weeks at Fort Benning, Ga., in 2003 because of his "entry level performance and conduct." Macbeth, who pleaded guilty, collected more than $10,000 in benefits to which he was not entitled, and his claims of war crimes were quickly disseminated on the Internet. U.S. District Judge Robert Lasnik sentenced him to five months in prison, followed by three months in a halfway house. At his sentencing Macbeth apologized for defaming veterans, while Lasnik noted that "too many people with a political agenda grabbed Mr. Macbeth's story and ran with it, according to a news release from the U.S. Attorney's office. Acting U.S. Attorney Jeff Sullivan said he served in Vietnam, and that his father, a B-24 pilot, was shot down and killed while bombing a Hanoi cement plant a week before Sullivan was born in 1943. He said he took the cases of these "phonies, liars and thieves" personally, and added that he hoped publicity about the cases would discourage others from doing it. Besides Macbeth, the cases include: -Reggie Buddle, 60, of Puyallup, who was sentenced to 500 hours of community service in July for posing as a decorated Marine Corps Chaplin and presiding over weddings, funerals and baptisms. -Larry Lewis Porter, 52, of Seattle, who was sentenced to 37 months in April for mail fraud in connection with a scheme to fraudulently obtain $134,000 in disability benefits. He pretended to have PTSD after serving in the Navy. -Roy J. Scott, 71, of Port Angeles, pleaded guilty Aug. 31 to using a forged military discharge form to obtain $22,000 in benefits, as well as unlawful wearing of military medals. He claimed to have been wounded in combat in Korea and to have won several medals, including the Purple Heart. He never served in Korea and was court-martialed out of the Marines. -Merrick K. Hersey, 64, of Vancouver, was indicted Aug. 1 on charges of using a forged discharge certificate to apply for benefits for post-traumatic stress disorder. A fugitive, Hersey cleaimed to have won a Bronze Star and two Purple Hearts in Vietnam. -Michael D. Heit, 58, of Harrington, pleaded guilty Thursday in U.S. District Court in Spokane to using a forged discharge certificate and falsely claiming military medals in posing as a Vietnam vet. -Elvin J. Swisher, 70, of Idaho, has been charged with taking $95,000 in unearned benefits and falsely posing as a veteran of the Korean War. -Carlos Riosvalle, 83, of Portland, Ore., was sentenced in Multnomah County in April for multiple counts of theft by deception. He collected nearly $23,000 in benefits after claiming to have been shot down during World War II; in fact, he never served. David Hunt Wednesday, September 26, 2007 Our generals are betraying our soldiers..... again Sorry, but I have to get your attention on this one. In both Afghanistan and Iraq, the United States Army - not the much maligned "LIBERAL PRESS" or BILL CLINTON or the LIBERALS IN CONGRESS - NO, the UNITED STATES MILITARY is prosecuting its soldiers for doing their jobs. I have tried, I have yelled, I have used nasty words. I have even tried to use humor, but none of this is sticking. You either do not believe me, or much worse, you do not care. We did one of these stories on O'Reilly last week. Two great Special Forces soldiers, along with their team, tracked down a terrorist who was on the 10 Most Wanted list in Afghanistan. The Special Forces soldiers were operating under the much- hated rules of engagement, which said to capture and kill the bad guy, who was a bomb maker and terrorist leader. The soldiers followed this killer to his house/compound, used guile and trickery and lured the waste of life out of his lair and put a bullet in his head. It was a perfect operation - a "Nice going guys," high fives, take the day off, "Get ready for the next one," type of operation. So how do you think our Special Forces soldiers were rewarded - or if not rewarded, treated - after this? THEY ARE BROUGHT TO TRIAL, INVESTIGATED AND FORCED TO SPEND THOUSANDS OF DOLLARS FOR LAWYERS. When the terrorist was first killed, the Army showed its trust in these bravest of the brave by investigating them twice. Both investigations, however unnecessary, found them innocent of any wrongdoing. So we now are so gun shy, so afraid and so massively politically correct, that we are treating combat like a police shooting. In most cities in this great country, if a police officer even shoots his weapon, he or she must face a board of inquiry. It makes the police officers crazy and causes all to look over their shoulders and to not trust their leaders -- but that is in a peaceful city, not a damn war zone. Our generals in both the Army and Marine Corps have cared more about their precious careers and reputations than their soldiers and Marines under them. The Marines have actually prosecuted a Marine for shooting a terrorist too many times and the Army - well, the Army has the Pat Tillman tragedy, the Abu Graib disaster and many more to answer for, and now these courts martial. In Iraq, the story is the same. The Army rediscovered a trick we used in 'Nam' called "baiting," where you leave ammunition and pieces of explosive devices out and shoot whoever takes them. We used to leave exploding ammo to put in your AK - when you try to fire it, the gun blows up. It worked then and it works now, but guess what the Army is now putting on trial: Ranger Snipers for doing their jobs. The rules of engagement were once again being followed and once again our generals put their careers over their men's lives. The chilling effect that these actions have over our soldiers is dramatic; this distrust weakens the very foundations of our military. It causes soldiers to second-guess themselves and their chain of command. We cannot fight like this and hope to win. We should be putting these generals on trial, first for going along with Rummy and just as important for not trusting their soldiers. At the very least, we should have a rule that states if you charge a soldier - like what happened in these cases - and they are cleared, YOU get charged and thrown in jail. Unfortunately, after the trials and after these soldiers' careers and lives have been ruined and after they clear up the mountain of debt they will amass from these trials, the generals involved will get promoted. These poor excuse for officers do not deserve the soldiers they dare claim they lead. We as a nation had better go out and find us another Marshall, who at the beginning of World War II fired hundreds of senior officers because they were not cutting it.
