| My friend is in the Coast Guard and is being investigated. Could he be kicked out?
My friend is being accused of Adultry. My friend wrote a statement which stated he was only friends with this girl who was married but had already filed for divorce. Apparently, the investigators had pictures pulled from my friends myspace. P.S. the pictures were not incrimintating. Its just of the 2 of them in a park. What could be his punishment?What constituts a relationship? Sexual intercourse?Also my friend stated that his command said that he couldnt date this girl even after she is divorced. I think they are just trying to scare him.

Nothing can be done if there is no evidence. A picture in the park is not enough evidence to kick him out. However, they can counsel him about what could happen to him if he is caught in an adulterous relationship. The military takes it very serious, although it happens often. I was in the military (Army) for 9 years and I saw it all the time. I think you friend should be okay as long as he dont admit to having a relationship beyond friendship, or they have no other witnesses who can give testimony to the fact that there was a relationship.

Actually if she had already filed for divorce prior to the relationship started then it is not adultery in almost all if not all states since it is a legal seperation. Adultery also has to be sexual activity and if the only thing they have is a picture of them in the park and nothing else it could not be proven. An investigation is just that-looking in to it to see if anything illegal had or was occuring; if their wasn't then nothing happens and if it was then it all depends on what the command does-NJP or courtmartial and then what the courtmartial decides as punishment. If he is found guilty at a CM then he could be discharged with a less then honorable discharge.

In the military, it is adultry if you have sex and one of you is married, the military does not care if you are legally seperated, filed for divorce, or anything like that... believe me, I was already investigated for that myself. The military does not make exceptions, but they can sometimes be selective in when to investigate or prosecute, unfortunately (I know of plenty of soldiers that their command had proof of the affair - ie, a baby was born from his mistress before he had even filed for divorce from his wife, and there was a paternity test to prove it to enroll the baby in DEERS).A picture at the park is not evidence, so if he says they are just friends, and she does not refute that, then he is fine. He may be hit with a no contact order, he would not be allowed to have any contact with her anymore, but once her divorce is final, he could ask for it to be cancelled, either way, it would need to be in writing. And usually adultry does not result in a discharge, just possibly an Article 15 if proven, so just extra duty and maybe loss of rank, depending on how mean the command wants to be.
