MissDemeanor is on a distinguished road
1st Offense DUI (la County) BAC .10- misdemeanor, good record- what do i have to look forward to?

I got my 1st & last DUI the other night. I just had dropped my friend off after leaving the bar, and had gotten something to eat, and was heading home. I came to a red light so I stopped behind the car in front of me. Next thing i knew the police were behind me telling me to pull over, so I did. He said I was tailgating.. .Then he proceeded to ask me if I had anything to drink. I didnt feel the need to lie, I felt fine, alert, satisfied, I just ate. I said yes. (i had had 2 drinks in the span of 3 hours, i am 5'3" 115lbs). SO then they had me do a field test. I passed no problem. I answered all there questions, no attitude.. just complied. THen they had me do the breathalizer.I never saw it, but they said it was.10.. SO, that was it.. scared out of my mind, in disbelief, i was cuffed and then shortly booked. My question is.. what do i face? is it possible to get a restricted license since i work nights? Community service? I have 0 points now. Do i need a lawyer? Help. Thank U.

If you only had 2 drinks in 3 hours there is no way you were over the limit, unless you drank two 12 ounce glasses of grain alcohol, get a lawyer and have the Breathalyzer tested.

You will be able to get an occupational liscense. It will cost you around $1000 in fines and classes. Probably no jail or community service. I dont think a lawyer could help to much. And of course high insurance. You dont want to get a second one.

If you had two drinks in the span of three hours, it would be impossible to have a 0.1, especially if you had just had something to eat. If what you're saying is true, I would undoubtedly get an attorney, and because you could POTENTIALLY recieve a jail sentence, you have a right to one even if you can't afford it. It's possible the breathalizer was faulty, or was not administered correctly. Who knows.

My buddy got 3 yrs probation & paid a $300 fine, the misdemeanor stays on your record forever but the only positive is that it is a victimless crime, heck there are cops that got dui's, youll be fine just stay out of trouble.

A conviction for DUI in this state has mandatory jail time associated with it. If you are convicted, you *will* spend some time in jail. However, the only thing the other posters have written that I will agree with is the comments regarding your drinking. If you had two "normal" drinks within three hours, there's no way you could be a .10% BAC. If you were drinking a "normal" drink, they would have been worth a little more than .02% BAC for someone your size. Judging by what you're saying, it sounds like you drank, then drove your friend home, then got something to eat - all of which is time passing and blood alcohol dropping. You either don't know how much you drank or there is something very rotten in Denmark. You're welcome to write me if you want to discuss this any further but something here isn't right, period.

About $1700-$2100 in fines and court fees, license suspension of 90-180 days, probation and wicked high auto insurance.
