| Statue of Limitations for Credit Card in NY?? I have a credit card with a few hundred dollars on it from when I lived in NY. I no longer live in NY but a lawyers has been trying to get me to settle the debt. It's been just under 3 years. Can they still take me to court? In response to BriarKat, I am not trying to get out of paying my debt, however, if they have already reported it as a negative debt on my credit report it will stay that way. Just because I pay it doesn't mean it disappears so what's the point!?      |

| In New York the SoL is 6 years. Be advised though that if you leave the state they can use the SoL from the current or former state, whichever is longer. If you want to pay it and get it deleted, do a pay for delete agreement (in writing). This means that in exchange for your payment on the account the negative listing is removed. Do not settle for a "paid" or "settled" listing...demand it be deleted completely or simply refuse to pay it. |
