| Why do people with disabilities get turned down EVERY time the first few times they
apply for benifits? It is soooo very frustrating. Even with the doctors letters and stuff my brother has been turned down twice. Now he is going to have to get a lawyer? This is so very wrong. He is unable to work and my parents are caring for him but they are getting older and are on a very limited income as they are both retired.

I was shocked. I retired due to physically being unable to perform my profession, at age 64. I was approved for disability social security after seven months ! It was tedious with all the paperwork documentation and confirmation by a doctor hired by social security. Thankfully my doctors spent much time and effort supplying documentation. Then I read in the local paper a man retired due to having a leg amputated (picture as well), applied for disability and was turned down ! Go figure ! |

I don't know why they do it, but I can tell you the best way to get their attention. I was hurt years ago, because I have always had copies of my doctors notes, no matter what doctor I had, when I applied for disability I'm sure they thought OMG. I brought in every doctors notes, showing what started my condition, how it has continued to cause more and more difficulties, and has caused other problems and all the notes on those. I had somewhere in the area of 1500 pages. They sent me to see their doctor for an evaluation and his statement to me was why did they even bother with this appointment. About three weeks later I revieved an approval and within another week my first check was in the bank. You have to provide them with as much information as you can. If they think they can get out of paying you they will. You have to fight for your rights. My step mother was on disability and they sent her to their doctors again after she had been on it about 5 years. The whole thing ended up in court. When they called on the doctor that had seen her he stood up and said, he didn't understand their problem, my stepmothers condition was so severe that should he not have had the paitent in his office and did the exam himself, when he saw the test results he would have assumed he was looking at the test results of someone deceased. My stepmother got this funny look on her face, the judge stated the award of disability was continued and he didn't want to see them back in there with her case ever again. So you just have to go after it and many attorneys will not charge you if they can't get you approved . Good Luck |

First of all, he doesn't have to get a lawyer. I have taken my Social Security Disability (SSDI) to an administrative law review hearing MYSELF. Your brother is at the step right before an administrative law hearing. Second, a lot of people get tired ot trying to get disability and go back to work, which is one of the reasons this occurs. Third, I know of several people (4) who got Supplemental Security Income (SSI) the first time they applied. So, the information you stated above is the norm, but by no means, does it apply all of the time.

It is wrong and it is not your brother's fault. The US government has recognized it as a problem, but has done little to change it. Sadly, your brother and your family are not alone. I don't think it is going to change anytime soon. Put a democratic in the White House and it might.

They see people with disabilities as more money problems. If you have a long term illness ,it will take a lot of money to take care of you. If someone else does not then they will be Health longer; and less money spent to take care of them. This is the way they stay in business. not through spending.We get mad but at the end of the day its just business. sorry |

I think it's because so many people take advantage of the system. I am not biased, but also maybe he's not the right ethnicity for the month. I have seen this type of discrimination with alot of our systems---Been there done that---Good luck to you tho, and see if the lawyer can get them to pay for his services, because I think it's wrong also. Sorry Hun--I wish I had happier news for you. |
