truck was issued to friend parked in driveway he ran from the police they had it

towed. They are saying we are the Police are telling us we are responsible for the truck to get out of the holding area and all the damages to the truck. Can they legally tow the truck they knew the truck belonged there they knew the driver was not the owner but towed anyway.
How are they not responsible
