is it illegal to swap cars with a friend when one party still has finance to pay and

the other party has not? if 2 people decide to do a straight swap on their cars between themselves and one still has armed forces finance to pay and the other owns his car with nothing to pay, is this illigal?
two people i know have done this and sorted out all the documents through BFG, nameing them owners of the swapped cars, now 2 months down line, man with finance claims to be in trouble for swapping with a years ban from buying any car in germany given to him by the army?
this to me sounds wrong as we sold our car 2 years ago and still had the finance which we payed off.
has the information been given wrong aout it being illigal?

Well the one with finance should not do it as the car is legally not theirs. If they stop paying the finance then the one who swapped could lose the car!!!

yes. The finance should have been transferred to the other vehicle. ie paid out or refinanced.

until the car has been paid for, it belongs to the finance company. If there is any problem in paying it off , they will need to recover their costs.
