Special Education?

I am extremely upset because i was put on "special education" for bad reasons and it has been my worst fear since i was only in elementary school. It has caused severe trauma and i am very worried about anyone finding out. There was a meeting early in the school year after the 1st marking period had ended and i had mostly As and Bs and there were 2 Cs, my GPA was 3.2 and those bastards gave me, "In class support" because i missed TWO HOMEWORKS in one of my classes. Is it possible for me to sue the schoolboard for traumatizing me?

The school cannot put you in special ed for missing 2 homework assignments. The school cannot put you in special education unless you were evaluated and found eligible under the laws of IDEA (individuals with disabilities education act). In order to be evaluated your parents/legal guardians have to sign a consent form, after being evaluated and if found eligible they cannot begin special ed services for you until you have an IEP* in place and signed by your parents/legal guardians, they are part of the IEP team that designs your IEP. (*individual education plan - a legal document designed to meet the unique educational needs of one child. The IEP must be tailored to the individual student's needs as identified by the evaluation process and must help teachers and related service providers understand the student and how best to work with that student. In other words, the IEP should describe how the student learns, how the student best demonstrates that learning and how the school staff and student will work together to help the student learn better.)
Even if you are found eliglible say for a 504 plan** your parents/legal guardians still have to sign it before it can be put into place.(**a legal document falling under the provisions of the Rehabilitation Act of 1973. It is designed to plan a program of instructional services to assist students with special needs who are in a regular education setting.)
