| When is the injury in an accident enough to avoid being charged with DWI or DUI? A vehicle with two occupants crashed, neither wearing seat belts. One died, the other came very close. The survivor, after a lengthy recovery, still has a slight degree of brain damage and other disabilities as a result of the accident. There are allegations by others that drinking or drug use was a factor in the accident, and that the survivor was the driver. (Neither is proven completely - no seatbelts and no drug or alcohol tests at hospital ER.) Should the survivor be tried for manslaughter DWI? At what point, if any, are the injuries already suffered by the accused enough punishment? Ever? |
