| I rec'd injuries in an accident were my roomate was driving, Can I clain pain... ...and suffering if we live togethr I had head injuries where they had to put staples in my head and I rec'd major bruises and abrasions to both knees and my wrist. Her insurance company says that the accident report doesn't even have me on there but they went ahead and covered my med bills. But they are saying since we live together I can't claim pain and suffering and get a settlement. I can't even ride in a car and not freak out now. Is there anything I can do and if not she is wanting me to sue her and I don't want to really cause I don't know what will come back on her or if insurance covers it. Any advice please let me know. |

| Yes, you can claim pain and suffering. DO NOT accept a settlement from the insurance company until all of your bills are paid (can take months to years to make sure all injuries are cured). Once you accept a settlement, the case is considered closed, and you cannot get any more money, even if you still have legitimate health problems. Best of luck. And document everything. P.S. If the insurance company tries to put it on your roommate, then she should sue her insurance company. She purchased the insurance, and they agreed via contract, that they would cover her. It may get ugly, but reassure her that you are after her insurance company, not her. |
