| Mock Court case in Language arts/social studies class?
Ok, in my humanities class, we are doing mock court cases based off of real court cases. I just want to know your opinion on this. This was a REAL court case in 1985.
T.L.O. was a 14-year-old high school freshmen who was caught smoking in the bathroom at her high school. The teacher who caught her sent her to the principal. The principal, based on suspicion, searched her purse to find cigarettes. Possession of cigarettes was NOT a violation of school rules at this point in time. Upon finding the cigarettes, which were on the top of the purse, he kept looking. After completely dumping the contents of the bag, he found money, marijuana, a pipe and an index card with people's names on it. T.L.O. was then charged with possession of marijuana and drug dealing. Is this constitutional? Is this fair?
The bill of rights states that there is to be no unreasonable searches or seizures. The principal had not recieved any evidence/suspicions that she was dealing drugs or had marijuana.
