What are the legal requirments on types of wood being burnt on a wood burner?

Our neighbours wood burner stinks !!!!!!!
They are burning old furniture and damp wood.
Is this legal ?
I have complained to the local council but they don't seem to interested.
I live in the UK.

They certainly shouldn't burn old furniture because the stains and varnishes may release toxic fumes , and never ever burn pressure treated wood . Maybe you could get in touch with your friendly neighbourhood environmentalists and see if they'll help you .

Here in the states, it's illegal to burn certain things.. Not specifically in a woodstove, mind you -- you just can't burn certain things.. Tires, for instance.. Shingles.. Stuff like that. You can be get fined if you do.. EPA thing, I think..

Anyway, so far as wet wood goes, let'em keep burning that. If they're dumb enough to burn green or wet wood, they've probably not got sense enough to keep their chimney swept, which means they're probably building a lot of creosote, which means they'll probably burn their house down with a chimney fire before long anyway. Problem solved.

Good luck.

I don't think there is any legal requirements my brother and sister in law have been burning wood to hear their house and water for over 30 years and when I asked they said the clean air act did not apply to wood burning stoves

Used to have a wood burning stove and was given an old telegraph pole to burn (not all at once you understand) and the smell was awful! Burning old varnished furniture is pretty grim too. I've tried it all. At least I didn't have any close neighbours to bother. Not sure you can do much about it. Maybe a quiet word with your neighbours might work if the authorities aren't interested.
