What is the legal age for sexual activity in NY?

My nephew started seeing a girl(she is 15 almost 16) when he was 17 (almost 18) now he just had a birthday and is 18 but she is still 15 and wont turn 16 until May. Ive told him he could get into alot of legal trouble if she ever gets mad at him and says he had sex with her or if her parents get mad and call the cops. Am I right? He doesn't believe me and they just think I'm being an over-protective bee-yotch.

Please lay down the facts for them since I will make sure they read this themselves so they know Im not making anything up!

As for WXXLER's comment, all the 'horny teens' should be in school right now....DUH, and I have preached the moral route. I'm hoping the lagality part will open there eyes along with the moral part. Thanks for your response anyway!

You need to find out the age of the Police Chiefs son, that's the age. My mistake it was the OC Ca sheriff's son that was busted for the gang rape of a little girl.
Try to be non sexual till you are established as a youth, or use protection. Keep your priorities straight.

I think 18 and 15 is alright. I believe it's a 5 year difference with someone under the age of 18. I know you have to be 16 to date someone 21.

It is illegal until she turns 17. I know someone who went to prison for 5 years for statutory rape.

New York is pretty strict. I'm quite certain that the legal age is 18.
