Is it against the law to NOT pay for your child's funeral with the life...

...insurance check?? I know its sorry but I was wondering if there is actually a law against it. My 9 month old grandbaby died and instead of the "dad"(I use this term loosely) paying for the funeral, headstone etc, he bought him a car and a computer with it. What should I do from here. The mom is here with me and they are separated.
I forgot to mention that he is active duty army band and is stateside. This just makes me sick that he did this as we dont have the money to pay for the funeral HE signed for saying he would pay.
