| 2nd Attempt RE: formulating legal principle from precedents?
Hopefully, I'm more clear in my question this time. Well, here it is... How is it that a legal principle is formed using precedents? What are the most common principles used? What makes a certain case significant enough that a legal principle is actually formulated? There are laws that are derived from legal precedents e.g. anti-cyberbullying statutes. How is it that a case can be so compelling that an actual statute/law is enacted regarding a certain issue? Examples will be appreciated and may help understanding. Thanks! |
