is it ok to have a common law marriage even if you are not yet divorced nor have a

legal separation? we've been separated for almost three years, now, i found somebody and we live together for more than a year. But i didnt file divorced and legal sepration agreement, and i have kid from my previous married.. so, is it okey f i will declare to the govt that i have a common law partner?
