Surname after divorce? So both of you are called "smith" when married. You get divorced. Can she call herself "Ms. smith" or would she still call herself "Mrs smith" if she wished to keep the surname? If he remarries and his second wife takes his name there would be two "Mrs smith" As the first wife is not his partner anymore shouldnt she call herself Ms.smith?

Considering that her status changed and she has the exact same name, she could likely revert to her maiden name without changing it legally. If she has the name Brown then married Smith, divorced Smith, her name would be Smith. If she legally changes it, then she could be Brown again.

It's really up to the ex wife which she prefers. It's not up to anyone else to worry about. There is no social protocol about it as far as I know, but any women I know who have kept their surname after divorce have remained as "Mrs." I'm not sure why.
