| I have been served papers for divorce in ca, I have a lein on the house.? When we separated, we did an inter spousal grant deed transfer with a promissory note attached. ( in 4/07 ) Now that I have been served, Does my husband have to sell the House? And Does the note get paid on the complete dissolution of marriage? He is trying to get out of it because he took a line of credit out on the home after the date of separation, ( and since the market is down 100K ) His share of the equity after paying off the first, and paying the lein would leave him very little.      |
