Is refusing to pay off a divorce settlement illegal?

My ex had until 8/07 to pay 20k for our divorce settlement. I received 20k He kept the house and the truck. So far he re financed the house twice, and this last month, sold the house. He still owes 9k but refuses to pay. Is there anything i can do?

You can take him back to court, but beware that most divorce attorneys do not fully understand that banks and mortgage companies do not have to recognize divorce degrees. So, if your X husband has sold the house and was supposed to pay off debt or a payout to you, it is very unlikely that he will face any legal consequences for not doing so. At this point, you can take your X husband to small claims court with a copy off your divorce degree to show evidence that he failed to pay of 9 grand. The court will allow your X husband to show evidence as well. If the court decides that he has not furfilled his legal obligation, they may allow a forced payroll deduction. Check with your local court because they may consider 9k to be outside of the small claims court. In this case, you will need to get an attorney or go directly to the court and file the papers for yourself.

He is in default and breach of his settlement agreement with you. You may get together with your attorney to contest this. Like child support, the court may garnish his wages if deemed necessary.
