My Exwife is trying to get Child Support from a Loan I already gave her money on.?

Didn't pay court ordered bills in my name. Hurt my credit on those too. I got her a loan in lieu of these issues to help her not foreclose. She agreed to pay back the loan with the Child support around 600 for the loan. I pay her more than this in child support monthly. She foreclosed the property while the 2nd loan is still active and on time and paid by me using the child support as she agreed in writing. She did not use the loan money for the kids. She paid off a BMW and loand her boyfriend over 10,000. Now she want to claim that I am a deadbeat - while now trying to get the 600 of child support from me while I also pay this loan. Am I in the wrong for trying to now protect myself? ANy thoughts on this? TY

it is hard to control what is spent on child support money when it is really for the children's need...they are expensive as you well know...se legal advice and see what you can do with the ex wife

So what you are saying that you are paying her 600 a month and then also paying back a loan that you took out that she was suppose to pay right? Well in that case if your name is on it then acually you are responsable for it, if it both names then you are equally responsable, best thing would to go back to court and let them figure it out

She cannot repay any loan with child support. It does not belong to her, it belongs to the children. The contract she signed is void because she has no right to use the child support to repay the loan.You need to just pay your child support because you can go to jail for not paying it. And you need to sue her for the loan.

I KNEW there was more to that story then she was telling. if the agreement was just between the 2 of you, you will have to go back to court and attempt to get the child support order modified. If it was agreed to in court, she will have to try to have the order modified. If this agreement was signed by a judge, she may have a very difficult time modifying it because the terms of the original agreement haven't actually changed. The loan was taken out and the payments are still due. Her failure to pay the FIRST mortgage is irrelevant, as it was not part of the original agreement.If this was something worked out just between the 2 of you, even if it was in writing, you have to follow exactly what the court order states while you attempt to have it modified. Unfortunately, that may be difficult. Agreements for child support done outside of the family court are not legally valid or enforceable. You may end up having to take the case to civil court if the loan was not included in the most recent child support order.
