i mean no green card...and your and your an illegal.....?

Depends on State law.

MOST States do not verify the immigration status of people presenting a divorce petition.

If the marriage is not recognized by the state authorities, then no divorce can be obtained. It's a big question these days for lots of Mexicans who married in Mexico, are now in the U.S., and want a divorce. Their marriage is not recognized in any U.S. or state courts, so no divorce is possible. We know of quite a few of these cases, where one or the other is trying to obtain a divorce in order to marry an American citizen, thinking this will keep them from being deported.

its not illegal, just not recognized divorce. as in you have no license to get married in the first place so they dont have to hear you case for divorce. also your home country will not recognize it.
