| What happens to house after a divorce in Florida? Can any type of agreement be...
...settled? I live in Florida with my wife and two children. If we divorce does the house have to be sold? If I don't get lawyors involved could I agree with my wife to continue paying mortgage payments so that she and the kids could live there in leiu of paying child support and alimony? I ask because I really would not want to take my children out of the neighborhood as a divorce would probably be difficult enough. I wouldn't want to put my wife out on hard times either. Possessions and money doesn't matter to me. In short, I guess my actual question would be: can any agreement be reached upon or drawn up if we don't involve lawyors?

It's whatever you and your wife agree to. The plan you suggest is not unusual--I've known families that worked out similar arrangements. As long as your wife agrees it's not a problem. Though, you need to get it in writing as part of your separation/divorce agreement with the help of a lawyer. Keep in mind that things change, and the written agreement will help resolve any questions or problems that will come down the road. Consider, for example, if your wife remarries or a boyfriend moves in with her--how will that affect your arrangement? What if she wants to move to a different house in 5 years?

Best to get a attorney as your <emoticons> are getting you confused> As how would you feel> agreeing with all that> & She is seeing a new guy or he moves in at your expense not cool and you won't like it an it will happen> You have rights also> So best see what they Are> Like the house you can help pay but when sold you get your money back or part of it>Child support yes but alimony?? Don't give the farm away?? Your intiled to 50% in Florida> Make your words soft & sweet as you may have to eat them> All will change when you are Divorced> So Get legal advise> Before signing or agreeing to anything> As it for a long long time>$$$$$ The children are your only obligation <not her>She can get a job> Best of luck been there> S&H |
