not divorced yet but ex claimed kids on taxes; i have custody.what can i...

...do? irs rejected me cuz he filed 1st. The soon to be ex and i started divorce proceedings Nov. 06 and did not live 2gether at all in 07. Divorce still not final. He claimed both our kids on his taxes, but I have Primary custody. No written agreement on taxes b/c divorce not final. What can I do since the IRS rejected my claim b/c he filed first and claimed the kids? AND he still has not paid me 1/2 of the return from our '06 taxes he and his lawyer agreed to. Do I have to take him to small claims court, or will the IRS even care that I am Primary Custodian and kids only see him for 2 days every 2 weeks? I REALLY need some advice; my lawyer NO HELP!!!
