help getting my income tax check out of my ex fiance's account!?

I just moved back to my home town in Texas from Las Vegas and i had to leave the abusive relationship while he was gone. Problem is he has my income tax check in his account. His mother is also on his account but i am not. I asked his mother to withdraw my half and she told me nicely, why dont you just tell me the amounts you need at a time and ill take it out for you. she is the nicest woman in the world but i dont know exactly how to tell her i want the whole check and be straight up with her and not be rude. the reason why she says a little at a time is beacuse she thinks i will move back with him and we will work it out and she doesnt want me to spend all my money and we have 2 kids. any advice on how to be straight up to her or how to tell her exactly??? please respond! please!
